refer to our software platforms, including all related features, tools, and services we offer.

refers to anyone accessing or using Alphally or Alphally-Lite, including but not limited to coaches, consultants, and other professionals.

"Content"

refers to any text, images, graphics, data, or other materials uploaded, posted, or shared on the platform.

"Showcase Material"

refers to content, including commercial photos and professional details, used to highlight work done for coaches and other clients.

2. Acceptance of Terms

By creating an account or using Alphally or Alphally-Lite, you confirm that you are at least 18 years old and agree to be bound by these Terms and Conditions.

3. Services Provided

3.1 Alphally and Alphally-Lite provide tools to help coaches and professionals manage their businesses, including CRM features, marketing automation, website hosting, and other digital solutions.

3.2 We reserve the right to modify or discontinue any part of the services without prior notice.

4. User Responsibilities

4.1 You are responsible for maintaining the confidentiality of your login credentials.

4.2 You agree to provide accurate, current, and complete information during registration and use of the services.

4.3 You must not use Alphally or Alphally-Lite for any unlawful purposes or in violation of these Terms and Conditions.

5. Payment and Billing

5.1 Fees for Alphally and Alphally-Lite services will be charged as outlined in your subscription agreement.

5.2 All payments are non-refundable unless otherwise stated in our Refund Policy.

5.3 We reserve the right to suspend or terminate your account if payments are not made on time.

6. Intellectual Property

6.1 All content and materials provided through Alphally and Alphally-Lite are the intellectual property of Alphally.io and protected under applicable copyright laws.

6.2 Users may not copy, distribute, or reproduce any part of the platform without prior written consent.

7. Showcase and Marketing

7.1 By using Alphally or Alphally-Lite, you grant us the right to showcase work completed for your business as part of our marketing and portfolio materials. This includes, but is not limited to:

Displaying commercial photos provided by you.Highlighting your profession, services, and success stories.

7.2 You agree that this showcase material may be used in various formats, including but not limited to:

Social media posts. Website case studies. Marketing campaigns.

7.3 If you do not wish for your work to be showcased, you must provide a written request to [email protected].

8. User Content and Privacy

8.1 Users retain ownership of all content uploaded to the platform but grant Alphally a non-exclusive license to use this content for service delivery and marketing purposes as outlined in Section 7.

8.2 We are committed to protecting your privacy. Please refer to our Privacy Policy for detailed information on how your data is collected, used, and stored.

9. Termination

9.1 We reserve the right to suspend or terminate your access to Alphally or Alphally-Lite if you breach these Terms and Conditions.

9.2 You may terminate your account at any time by contacting [email protected].

9.3 Upon termination, any outstanding payments must be settled immediately.

10. Limitation of Liability

10.1 Alphally and Alphally-Lite are provided "as is" and "as available." We make no warranties regarding the platform’s performance or reliability.

10.2 We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.

11. Indemnification

You agree to indemnify and hold Alphally.io, its employees, and affiliates harmless from any claims, damages, or losses arising out of your use of Alphally or Alphally-Lite.

12. Governing Law

These Terms and Conditions are governed by the laws of New South Wales (NSW), Australia. Any disputes shall be resolved in the courts of New South Wales.

13. Amendments

We reserve the right to update or modify these Terms and Conditions at any time. Continued use of the platform constitutes your acceptance of the revised terms.
